1. Acceptance of Terms
By downloading, installing, accessing or using the Cham Cars mobile application (“Cham Cars” or the “App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use the App.
These Terms form a legal agreement between you (“you”, “user”) and Cham Solutions and Programs (“Cham Solutions”, “we”, “us”, “our”), the owner and operator of Cham Cars.
2. About Cham Cars
Cham Cars is a listing and information platform that allows users to publish and browse advertisements for vehicles, primarily targeting the Syrian market.
Cham Cars itself does not own, buy, sell, import, export, finance, or insure any vehicles, and does not act as a car dealer, broker, agent, or auctioneer for any user. We only provide a venue where sellers and buyers can find each other.
3. Eligibility and User Accounts
3.1 You must be legally capable of entering into binding contracts under the laws applicable to you to use the App.
3.2 Some features may require you to create an account. You agree to:
• Provide accurate, current and complete information;
• Keep your login credentials secure and confidential;
• Be fully responsible for all activity that occurs under your account.
4. Use of the App
4.1 You may use the App only for lawful purposes and in accordance with these Terms.
4.2 You agree not to:
• Use the App in any way that violates applicable local, national or international laws or regulations;
• Use the App to post, transmit or store any false, misleading, fraudulent, offensive, defamatory, obscene, or illegal content;
• Use the App to advertise stolen vehicles or vehicles that you are not legally authorized to sell;
• Interfere with or disrupt the App or servers, including by introducing viruses, malware or other harmful code;
• Attempt to gain unauthorized access to any part of the App, other user accounts, or any related systems or networks.
5. Our Role: Listing Platform Only (Not a Broker or Dealer)
5.1 Cham Cars is only a platform that allows users to list and search for vehicles. We are not involved in, and are not a party to, any communication, negotiation, transaction, payment or contract between users.
5.2 We do not:
• Buy or sell vehicles on our own behalf;
• Represent any user as an agent, broker or intermediary;
• Guarantee that any buyer or seller will complete a transaction;
• Inspect or verify vehicles, documents, ownership, mileage, condition, or history;
• Provide any warranty regarding the quality, safety, legality, roadworthiness, or suitability of any vehicle.
5.3 Any agreements, payments, inspections, or test drives are strictly between users. You are solely responsible for performing your own checks, due diligence, inspections, and negotiations before completing any transaction.
6. Listings and User Content
6.1 Users who post listings (“Sellers”) are solely responsible for:
• The accuracy, completeness, and legality of all information and photos in their listings;
• Ensuring they have the right to sell the listed vehicle;
• Complying with all applicable laws (including tax, customs, and registration requirements).
6.2 By posting content (including text, images, and other materials) on the App, you grant Cham Solutions a worldwide, non-exclusive, royalty-free license to use, display, reproduce, modify, and distribute such content in connection with operating and promoting the App.
6.3 We may, at our sole discretion, edit, refuse to publish, or remove any listing or content that we believe violates these Terms or applicable law, or that may harm our users or our reputation. However, we have no obligation to monitor or actively verify user content.
7. Prohibited Content and Activities
You agree not to post or engage in content or activities that include, but are not limited to:
• Advertising stolen, illegal, or non-existent vehicles;
• Misrepresenting the condition, ownership, mileage, or history of a vehicle;
• Using copyrighted photos without permission;
• Harassment, threats, hate speech, or discrimination;
• Spam, scams, phishing or any fraudulent scheme.
8. Communications and Notifications
8.1 The App may allow you to contact other users by phone, messaging apps (such as WhatsApp), or in-app features. You are responsible for all communications you send and receive.
8.2 We are not responsible for the content of user-to-user communication or any agreement reached through such communication.
9. Third-Party Services and Links
The App may contain links to third-party websites or services (for example, messaging services, map services, or external resources). These third parties are not under our control, and we are not responsible for their content, policies, or practices. Your use of any third-party service is at your own risk and subject to that third party’s terms and policies.
10. No Warranty
10.1 The App is provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied.
10.2 Without limiting the foregoing, Cham Solutions does not warrant that:
• The App will be uninterrupted, secure, or error-free;
• Any content (including vehicle listings) will be accurate, complete, current, or reliable;
• Any transaction between users will be successfully completed or free of fraud.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
11.1 Cham Solutions and its directors, employees, partners, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or related to:
• Your access to or use of, or inability to access or use, the App;
• Any conduct or content of other users or third parties;
• Any transaction or attempted transaction between users, including relating to the purchase or sale of any vehicle;
• Any unauthorized access, use or alteration of your transmissions or content.
11.2 If we are found liable for any claim, our total liability to you will be limited to the greater of: (a) the amount you paid to us (if any) for using the App during the last 3 months before the claim arose, or (b) [a nominal amount you choose, e.g. USD 50].
12. Indemnification
You agree to indemnify, defend and hold harmless Cham Solutions and its directors, employees, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
• Your use of the App;
• Your violation of these Terms;
• Your violation of any rights of another person or entity;
• Any listing you post or transaction you enter into with another user.
13. Termination and Suspension
13.1 We may suspend or terminate your access to the App, at any time and without prior notice, if we reasonably believe that you have violated these Terms or any applicable law, or if we decide to discontinue or significantly modify the App.
13.2 You may stop using the App at any time. If you wish, you may request that we deactivate or delete your account, subject to our legal obligations to retain certain data.
13.3 Termination does not affect any rights or obligations that have already accrued up to the date of termination.
14. Changes to the App and to These Terms
14.1 We may update or change the App (including adding or removing features) at any time, without prior notice.
14.2 We may also update these Terms from time to time. When we do, we will change the “Last updated” date at the top. Continued use of the App after updated Terms are published will constitute your acceptance of those changes.
15. Governing Law and Dispute Resolution
15.1 These Terms and any dispute arising out of or relating to them or to the App will be governed by and construed in accordance with the laws of [Country / Jurisdiction – to be specified].

16.3 You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.
